These Terms govern your use of the Hardstamp app. By using Hardstamp you agree to them. If you don't agree, don't use the app.
Hardstamp is a documentation tool. It records network-verified time and GPS at capture and burns them into your photos and videos.
Hardstamp records network-verified time and GPS at capture. It does not certify legal admissibility and does not provide legal advice.
Hardstamp does not determine legal outcomes, does not certify that any capture is admissible as evidence in any proceeding, and does not provide legal, insurance, or warranty advice. Whether and how your records may be used is between you and your own advisors.
You retain all rights to the photos, videos, documents, and information you create and store with Hardstamp. Because that content lives on your device, you are responsible for backing it up and for keeping your device secure.
Use Hardstamp lawfully. You are responsible for having the necessary permission to photograph a work site and to collect and store your customers' information.
Hardstamp is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that time and location readings will always be available (for example, when a device is offline, the stamp honestly labels the time as device time rather than network-verified).
To the fullest extent permitted by law, Home Run Unit LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Hardstamp. Our total liability for any claim relating to the app is limited to the amount you paid us for the app in the twelve (12) months before the claim arose.
If you obtained Hardstamp through the Apple App Store, Apple's standard End User License Agreement also applies, and where these Terms conflict with that EULA for App Store purposes, the applicable terms of Apple's standard EULA govern. Apple is not responsible for the app or its support, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you as a user.
You may stop using Hardstamp at any time by deleting it. We may suspend or end the app or these Terms if you violate them or if we discontinue the product.
We may update these Terms. When we do, we'll change the effective date above, and the app will ask you to acknowledge material changes before you continue.
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules.
